Terms of Service

1. Introduction

Welcome to Atlas Graphics. These Terms of Service ("TOS") govern your access to and use of our digital content creation services. By hiring us for your project, you agree to be bound by these terms.

2. Scope of Work

We provide custom digital content creation services including, but not limited to, product rendering, 3D image compositing, 360° photography, High Dynamic Range Imaging (HDRI), photogrammetry, and material design. Each project is outlined with detailed estimates that clearly label the deliverables, cost, timeframe, and any other relevant information. These estimates serve as the agreement between Atlas Graphics and the client, detailing the scope of work and expectations for the project.

3. Estimates and Quotes

Upon receiving a project request, we will provide an estimate based on the scope of work. Estimates are valid for 30 days. The final cost may vary if the project scope changes. Please note that the provided estimate is an approximation based on the initial project scope and our hourly rate of $100. The final invoice will reflect the actual hours worked, and therefore, the total cost may differ from the initial estimate.

Any significant deviations from the estimated hours resulting in an increase of over $100 will be communicated and approved by the client before proceeding. If requested by the client, any price increase will be communicated.

The client's acceptance of the estimate serves as agreement to proceed with the project under the terms outlined in this document.

4. Pricing and Payment Terms

  • Pricing Structure: Our services are billed at an hourly rate of $100 with all renders (final and preview) being billed at an hourly rate of 75¢.

  • Payment Schedule:

    1. 50% upfront deposit before starting the project. Once payment confirmation is received, the project will be started.

    2. Remaining 50%, including any increases in price from the original estimate, upon project completion and delivery.

  • Expedited Services: For projects needed sooner than the 1 week minimum timeframe, expedited services are available at an additional cost. Expedited services incur a 25% increase over the base cost.

  • Weekend Hours: Our standard working hours are Monday through Friday from 10:00 AM to 5:00 PM. Projects requiring work during weekends or outside of our standard working hours may be subject to additional charges. Weekend hours incur a 50% increase over the base cost.

  • Combined Charges: Note that both expedited services and weekend hours charges are additive. Clients requiring both expedited services and weekend hours may be subject to a total increase of 75% over the base cost.

  • Payment Methods: We accept bank transfers, checks, and cash.

5. Invoicing

Invoices will be issued according to the payment schedule outlined above. Payment is due within 14 days of the invoice date. Late payments may incur a late fee of 10% per day.

6. Revisions and Changes

  • Revisions: We offer 3 free revisions. Additional revisions will be billed at our standard hourly rate of $100.

  • Scope Changes: Any changes to the project scope after the initial agreement will require a new estimate and may affect the project timeline and cost.

7. Delivery and Acceptance

Final deliverables will be provided in the requested file format by the agreed-upon deadline. The client will have 14 days to review and request any final adjustments. If no feedback is provided within this period, the project will be considered accepted and payment will be expected within 14 days from then.

8. Minimum Project Timeframe

All projects require a minimum timeframe of 1 week for completion, regardless of the project's size and scope. This ensures adequate time for quality work and revisions. This minimum timeframe begins after acceptance of the project's estimate by the client.

9. Cancellation and Refunds

  • Cancellation by Client: If the client cancels the project after work has commenced, the upfront deposit is non-refundable.

  • Cancellation by Us: We reserve the right to cancel the project at any time, with a full refund of any payments received for undelivered work.

10. Intellectual Property

Upon full payment, the client will own the final work. We reserve the right to use the work for portfolio purposes, unless a non-disclosure agreement (NDA) is in place.

11. Confidentiality

We will treat all client information as confidential and will not disclose any details without prior consent. If required, an NDA can be signed to formalize this arrangement.

12. Liability and Disclaimers

Our liability is limited to the amount paid for the project. We are not responsible for any indirect, incidental, or consequential damages arising from the use of our services.

13. Termination of Services

Either party may terminate the agreement with 30 days' notice. Any work completed up to the termination date will be billed accordingly.

Termination of services requires any outstanding payments to be settled before termination.

14. Governing Law

These terms are governed by the laws of California. Any disputes arising from these terms will be resolved in the courts of Napa County.
